Terms of Service
These Terms of Service (“Terms”) govern use of the online payment portal at payments.lawyerupjax.com (the “Service”) operated by Shafer Law, P.A.(“the Firm”). By using the Service, you agree to these Terms.
1. Who may use the Service
The Service is intended for existing clients of Shafer Law, P.A. who have received a payment link from the Firm. The Service is not a request for representation and use of the Service does not create an attorney-client relationship. An attorney-client relationship is established only by a written and signed engagement agreement with the Firm.
2. Payments
Payments are processed by Stripe, Inc., a third-party payment processor. By submitting a payment, you authorize Stripe to charge your selected payment method for the amount shown on the invoice. The Firm does not store payment card or bank account numbers.
If a payment is returned, reversed, or charged back, the Firm may re-bill the underlying invoice and may pass through any processor-imposed fees.
3. Refunds
Refund requests for payments made through the Service should be directed to the Firm by phone or email. Refund eligibility depends on the terms of the underlying engagement agreement and applicable Florida Bar rules.
4. SMS and email communications
The Firm may send invoices and payment reminders to clients by email and, with written consent, by SMS text message. SMS communications are governed by the Privacy Policy. You may opt out of SMS at any time by replying STOP to any text message from the Firm.
5. Security
We take reasonable measures to protect information transmitted through the Service, including TLS encryption in transit and access controls on stored data. No method of transmission or storage is 100% secure; we cannot guarantee absolute security.
6. Acceptable use
You agree not to:
- Attempt to access the Service's administrative interfaces without authorization.
- Use the Service to make payments to accounts other than your own.
- Probe, scan, or test the vulnerability of the Service without prior written permission.
- Use automated means to scrape, crawl, or extract data from the Service.
7. Intellectual property
The Service, its design, and its content are the property of Shafer Law, P.A. and its licensors. You may not copy, modify, distribute, or create derivative works without permission.
8. Disclaimers
The Service is provided “as is” without warranties of any kind, express or implied. The Firm does not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. Nothing on the Service constitutes legal advice.
9. Limitation of liability
To the maximum extent permitted by law, the Firm shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service. The Firm's aggregate liability for direct damages shall not exceed the total amount you paid through the Service in the twelve (12) months preceding the claim.
10. Governing law
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved in the state or federal courts located in Duval County, Florida, and you consent to the personal jurisdiction of those courts.
11. Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected in the Effective date at the top of this page. Continued use of the Service after a change constitutes acceptance of the updated Terms.
